Federal High Court dismisses objections, case proceeds
The Federal High Court in Abuja has ruled against the Nigerian National Petroleum Company Limited (NNPCL) in its attempt to stop a ₦100 billion lawsuit filed by Dangote Petroleum Refinery.
The case challenges the importation of refined petroleum products into Nigeria, a move Dangote argues violates the Petroleum Industry Act.
Court Rejects FCCPC’s Involvement
Justice Inyang Ekwo dismissed the request by the Federal Competition and Consumer Protection Commission (FCCPC) to be included in the case.
The commission had argued that the lawsuit was an attempt by Dangote Refinery to monopolize the market, but the judge ruled that the dispute could proceed without FCCPC’s involvement.
The Lawsuit: Key Points
- Dangote Refinery is suing the Nigeria Midstream and Downstream Petroleum Regulatory Authority (NMDPRA), NNPCL, and five major oil marketers.

NNPCL’s Defense Falls Flat
NNPCL objected to the lawsuit, arguing that it was sued under a non-existent name (“NNPC” instead of “NNPCL”).
However, the court dismissed this argument and allowed Dangote Refinery to amend the suit to reflect the correct name.
Justice Ekwo ruled that NNPCL’s objections lacked merit, clearing the way for the case to proceed. The next hearing is scheduled for March 6, 2025.
