The battle over U.S. election laws has taken a dramatic turn as the Democratic Party sues the Trump administration over a controversial executive order that could change how Americans vote.
The lawsuit, filed on Monday by the Democratic National Committee, Senate Minority Leader Chuck Schumer, and House Minority Leader Hakeem Jeffries, aims to block Trump’s directive that requires proof of citizenship—such as a passport—for voter registration and prevents states from counting mail-in ballots arriving after election day.
According to the lawsuit, the order, titled Preserving and Protecting the Integrity of American Elections, is an overreach of presidential power and threatens to strip millions of eligible voters of their rights.
“The President does not have the authority to dictate election rules,” the complaint argues, warning that the changes could disenfranchise many lawful voters.
Since losing the 2020 presidential election, Trump has repeatedly pushed unverified claims of election fraud, especially regarding mail-in ballots.
With this new order, he describes the move as “the farthest-reaching executive action taken” to safeguard election integrity.
Legal experts and voting rights groups are pushing back. The Campaign Legal Center and the State Democracy Defenders Fund have filed a separate lawsuit, calling Trump’s directive unconstitutional.
“This order threatens to dismantle our established election system and silence the voices of millions of Americans,” said Danielle Lang of the Campaign Legal Center.
Critics argue that the president lacks the power to single-handedly change voting rules, which are set by Congress and state governments.
